Artificial Intelligence (AI) Policy

OUR APPROACH TO USING AI IN OUR RESEARCH 

Generative AI has become a very powerful tool to process, structure, and create text and graphics. Lux Research actively seeks to use that power to enhance our research and better serve our clients. At the same time, the real added value of our research lies in the knowledge, thought leadership, and experience of our analysts and the data they collect and curate through primary research. Generative AI cannot substitute for that value — but it can help multiply that value and make it more accessible to our clients. These are our principles when using AI.

WE USE AI TO MAKE OUR RESEARCH MORE ACCESSIBLE AND PROVIDE ADDITIONAL FEATURES

Lux Research develops AI tools that generate content for our clients on our platform. One example is the predictive anthropology tool that uses AI to generate a direct response to questions clients enter on our site. We will be releasing more tools like it, but they always adhere to the following basic principle.

  • Clients will always know if a result has been entirely generated by AI. When it is not mentioned explicitly that a report or other piece of research was generated by AI, clients can be assured that it was written by one of our analysts and has gone through our rigorous quality assurance process of content and copy editing before publication.
  • When we provide a custom response to clients that has been generated by AI, the AI tool will base its response on research that was previously generated and edited by our team of analysts. We use AI tools and workflows that have been carefully designed, tested, and optimized with extensive expert input, using data sources and queries that have been curated by our experts, and monitored for quality on an ongoing basis by Lux experts. These tools are used to assemble and structure a response to questions posed by our clients using our research and, where applicable, drawing on data sets that have been selected and curated by Lux experts, such as the consumer conversations analyzed by our MotivAI tool.
  • We also use AI tools to provide additional research content on top of our ongoing analyst-written content. For instance, in our coverage of innovative companies on our Lux Lists, our analysts continue to write custom Innovator Assessments based on primary research for the companies we’ve identified as the top players in each technology. However, we now also provide information about companies that we have not interviewed; this information has been assembled automatically by Lux Research’s proprietary AI tool that was specifically developed by Lux for this purpose. In accordance with the principles above, these descriptions are clearly labeled as AI generated, and Lux Research analysts have designed and tested this tool and continue to supervise it, making improvements where needed.
  • Every Lux Take we provide about an innovation or innovator is the opinion of the Lux team and written by one of our analysts. When a Lux Take is provided, it is based on research performed by our analysts and written by our analysts, even if the information presented about the company has been generated by our AI tool.

 

WE USE AI TOOLS TO MAKE OUR ANALYSTS BETTER AT THEIR JOB

In the course of their research, our analysts read and process large amounts of text and information. Generative AI can help them do that faster and more accurately. We use AI tools in our research to improve quality, reliability, and productivity, just like our analysts use many other tools such as literature databases, patent search engines, etc. When using generative AI and other tools, the following principles apply.

  • All written research is the original work of our analysts. We do not allow any form of plagiarism and that includes copying text originally generated by AI tools without proper citation. All text and figures not originally conceived by our analysts will only be used with clear reference to the source.
  • If that source is an AI tool, the reference will mention which tool was used and on which date.
  • Our analysts will use AI tools to edit text originally conceived by our analysts to make it more concise, easier to read, and more consistent with our templated deliverable formats. When an AI tool is used only to edit text, this is not labeled as generated by AI. We use AI tools to edit, just like we use spelling- and grammar-checking tools. The final version is always edited by our analyst.
  • Every original piece of research is subject to our quality assurance process. This means it is reviewed in at least two iterations for content, recommendations, and language quality by experienced and trained subject-matter experts and professional editors. Our editors check references to source data and cited text.

Copyright/Quote Policy

To quote, reference, or use any research excerpt by Lux Research Inc., an email request must be submitted to approvals@luxresearchinc.com. Submitted request must include document title and date, and figure or quote requested. All content © 2021, Lux Research, Inc. We will respond to requests within 1 business day, if all required information has been provided. 

Event Media Consent Policy

When you enter a Lux Research (“Lux”) event or program, you enter an area where photography, audio, and video recording may occur. By entering the event premises, you consent to photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for promotional purposes, inclusion on websites, social media, or any other purpose by Lux and its affiliates and representatives. Images, photos and/or videos may be used to promote similar Lux events in the future, highlight the event and exhibit the capabilities of Lux. 

You release Lux, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of photographs, computer images, video and/or sound recordings. By entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by Lux or the person or entity designated to do so by Lux. You have been fully informed of your consent, waiver of liability, and release before entering the event.

Lux Analyst Inquiry Policy

A Lux analyst inquiry is a formal product deliverable and is defined as follows: A 50-minute virtual conversation between a licensed member (the client must be licensed to schedule an inquiry) and a Lux expert (whether an analyst or consultant). If the Lux Advisory or Executive member has an Insight membership attached to their subscription, those Insight members are allowed to attend the inquiry. As our commitment to our clients, inquiry submissions will receive an acknowledgement of submission within 48 business hours of receipt, and Lux will use its best efforts to respond to Inquiries within 14 business days. Virtual inquiries are limited to two hours of Lux expert time per inquiry, including preparation and follow-up. Some queries may require multiple inquiries to answer; if the client wishes further discussion after the initial call, follow-up inquiries may be scheduled as necessary according to each client’s contract provisions.

Analysts will not conduct any custom primary or secondary research for clients via the analyst inquiry, including custom assessments for clients. Lux may share existing presentation materials during the conversation, at the expert’s discretion, but will not build custom decks for an inquiry. Inquiry is a conversation between an analyst and a client member or members. If a formal presentation and/or a larger audience is required, such requests can be fulfilled under our Lux Expertise services. While our default as an organization is a virtual, face-to-face inquiry delivery, we also will fulfill client inquiries via email in written form when appropriate, at the discretion of the Lux expert answering the inquiry.  If an inquiry topic is not among Lux’s areas of expertise, Lux will determine if there is an analyst who might be able to converse with a client, but Lux does not guarantee this outcome.

Lux may record Inquiry calls for internal note taking and record-keeping purposes. These recordings will not be distributed externally, in either written or audio form. Lux does not allow anyone outside of the company that has licensed our IP to participate in an analyst inquiry. The call will be immediately ceased if there are unauthorized participants on the call. As our inquiries are confidential for our clients, Lux cannot allow anyone outside of the client organization or the Lux team on inquiries due to the NDA and confidentiality clauses in our member service agreement.

Privacy Policy

Lux respects your privacy and is committed to protecting your personal information. This Privacy Policy (this “Policy”) describes what personal information we collect; how we collect, use, maintain, protect, and disclose that information; and your choices and rights regarding your personal information. Please read this Policy carefully.

In this Policy, references to “we,” “us,” or “Lux” are references to Lux Research, Inc. and all of its affiliated companies, including Lux Research B.V., Lux Research Asia Pacific PTE, LTD and MotivIndex Inc.. Lux Research, Inc. and all of its affiliated companies will have access to the personal information covered by this Policy.

By using our websites, registering for or attending our events, or using our products or services, you accept and agree to be bound by and abide by this Policy. If you do not agree to this Policy, you should not use our websites, register for or attend our events, or use our services.

We may update this Policy from time to time. When we update the Policy, we will change the Effective Date at the top of the Policy and post the updated Policy on our websites. We encourage you to check back frequently for current information on how we are protecting your information. By continuing to use our websites, registering for or attending our events, or using our products or services after a Policy update, you agree to the privacy practices described in the updated Policy.

SCOPE

This Policy describes our practices relating to your personal information when you:

  1. Create, activate, and use a Lux Member ID to access the Lux Member Site;
  2. Express an interest in or sign up for our products or resources;
  3. Register for or attend a virtual or in-person Lux event; or
  4. Visit our websites (including our public and/or member-based websites) or social media sites.

This Policy also applies to information we collect from you via our survey tools as outlined in more detail below. You may be shown an additional confidentiality notice before participating in a survey. Please note that in cases where the terms of any such survey-specific confidentiality notice conflict with any terms in this Policy, the terms of that notice will take precedence over the terms in this Policy.

This Policy will apply whether you have provided the information directly to us or we have obtained it from a different source, such as a third party.

1.  INFORMATION THAT WE COLLECT ABOUT YOU

1.1 Data Collection and Use

The personal information we collect depends on the context of your interactions with us, the choices you make, and the services you use. The types of information we collect, the sources from which we collect it, and the reasons for collecting it are described in the chart below.

Information we collect directly from the following sources:

  • You
  • Referrals or recommendations, including from within Lux or from a third party
  • Social media sites and other external internet sites (such as LinkedIn)
  • Publicly available resources, such as telephone directories, newspapers, internet sites, commercially available data resources, public registries, or public records
Categories of information we collect about you from such sources include:
  • Information you provide when you enter information on our websites, such as when you provide contact details, respond to online questionnaires, or submit feedback forms
  • Information you provide when you subscribe to email newsletters or our blog (such as name, email, job title)
  • Information you provide when registering for a Lux Member ID (such as name, business or personal email, job title, organization, organization’s physical address, direct telephone number, profile photograph, and biographical details)
  • If you have registered for a Lux Member ID, log-in credentials and information about your use of and preferences for these services
  • Information about communications with you
  • Information you provide when posting content on social media sites
We use this information for certain activities, including:
  • Enabling you to access the Lux Member Site across devices
  • Personalizing your experience of our websites
  • Providing more customized customer service
  • Administering our websites
  • For internal analysis and research to help us improve our existing products and services and to create new products and services
  • Marketing our products and services and promoting our business and brand
  • Enabling peer networking opportunities based on your background and experience
  • Investigating complaints
  • Monitoring social media content to manage customer relations and promote our business and brand
We use this information because:
  • It is necessary to perform our obligations or exercise our contract rights
  • It is necessary to comply with applicable laws or regulations
  • We have a legitimate business interest to manage and promote our business and brand; to monitor, investigate and report any attempts to breach the security of our websites; provide and improve our services; and operate our business
  • We have your consent (where required under applicable law) to use your information for marketing. Where we rely on your consent, you have the right to withdraw consent by contacting us at security@luxresearchinc.com.
Information we collect when you register for or attend one of our virtual or in-person events
Categories of information we collect about you include:
  • Registration information (such as name, business email, profile photograph, job title, phone number, company name, country, professional biography, dietary restrictions and/or food allergies, and payment information)
  • Information collected when we record or photograph our events
We use this information for certain activities, including:
  • Enabling you to attend our events
  • Conducting our events
  • Sending Lux research and materials that may be of interest to you
  • Analyzing attendee interest in, and interactions with, our events
  • Marketing our events, including through the use of video
  • Providing recordings to interested business contacts, attendees, and others directly and online through our websites or Lux social media sites
We use this information because:
  • It is necessary to perform our obligations or exercise our contract rights
  • It is necessary to comply with applicable laws or regulations
  • We have a legitimate business interest to manage and promote our business and brand, provide and improve our services, operate our events business, and collect relevant information for hospitality and health and safety purposes
Information we collect about the use of our websites from users
Categories of information we collect about you include:
  • Information captured in our web logs, which may include device information (such as device brand and model, screen dimensions), unique identification numbers (such as IP address), browser information (such as URL, browser type, pages visited, date/time of access), geolocation and other device-specific information, and Internet connection information
  • Advertising information (such as size/type of ad, ad impressions, location/format of ad, data about interactions with ad)
  • Behavioral information (such as information on the behavior or presumed interests of individuals on our websites), which may be linked to those individuals and used to create a user profile
  • Information captured by our cookies (please see the section below on Cookies and Similar Technologies)
We use this information for certain activities, including:
  • Personalizing your experience of our websites
  • Administering our websites
  • Performing statistical and trend analysis to improve the user experience and performance of our websites
  • Providing enhanced, more customized customer service
  • Detecting and preventing fraudulent and/or unlawful use of our websites, products, and services
  • Investigating complaints
We use this information because:
  • It is necessary to comply with applicable laws or regulations
  • We have a legitimate business interest to:
    • Monitor, investigate and report any attempts to breach the security of our websites

Information we collect from participants of a survey

  • Personal information (such as name, title, contact details, and company name)

  • Conducting general research, including creating or updating aggregate benchmark data sets and reports
  • Providing our services
  • Developing new products and services
We use this information because:
  • We have a legitimate business interest to provide and update benchmark data and analysis and to validate and update our products and services

1.2 Special Categories of Information

Certain types of personal information are more sensitive than others. This includes information about health, disability, race, ethnicity, criminal offenses (or alleged offenses), political opinions, biometric information, and religion. We never require you to disclose this information, but there are a few circumstances in which we may request it. We have identified where we do collect and receive this type of information about you, how we will use it, and why we use it in the charts below.  We will not use the information for any purpose other than the purposes disclosed below.

 

Information we collect when you attend one of our virtual or in-person events

Categories of information we collect about you include:

  • Dietary requirements that may imply specific religious beliefs or medical conditions
  • Any physical or mental disability or impairment you may disclose to us to request accommodations or for other reasons

We use this information for certain activities, including:

  • Providing hospitality that is suitable for attendees of our events

Special category information that you choose to provide voluntarily as part of a survey

Categories of information we collect about you include:

  • Certain surveys may be configured to collect optional demographics such as race, ethnicity, or disability status

We use this information for certain activities, including:

  • Validating and analyzing surveys 
  • Conducting general research, including creating or updating aggregate benchmark data sets and reports
  • Providing our services
  • Developing new products and services

We use this information
because:

  • You have consented by providing us with the information. You have the right to withdraw consent by contacting us at security@luxresearchinc.com.

1.3 Further Information

If the purpose described in the charts above for which we use your personal information is our “legitimate interests,” our legitimate interest will only apply if we believe your interests or rights in protecting your personal information do not override our legitimate interests. For more information regarding our legitimate interests as applied to your personal information, please contact us using the contact information provided at the end of this Policy.

In certain circumstances, if you do not provide personal information that is required (for example, in relation to activating your Lux Member ID), we will not be able to perform our contractual obligations or provide you with products and services. When this is the case, we will make it clear.

Photography and Recordings 

We may ask to record calls for training, quality assurance, or research purposes. All recordings will be treated as confidential. If you do not want us to record your call, you will be given a chance to opt out. If your call is already in progress, you may ask us to turn off the recording at the start of the call.

If you agree to participate in a recorded video meeting, the record of that meeting and any associated analysis may contain personal information that you have disclosed about yourself and others (such as names, titles, contact information, company, location, your image). You should not disclose any personal information about any other person. If you do, it should be on the basis that you have the consent from that person to disclose their personal information to Lux and you will ensure they are provided with a copy of this Policy.

When you enter a Lux event, you enter an area where photography, audio recording, and video recording may occur. Photographs, audio recordings, and video recordings may be used to promote similar Lux events in the future, highlight the event, and exhibit Lux’s capabilities. By entering the event premises, you consent to any photography, audio recordings, video recordings and their release, publication, exhibition, or reproduction for promotional purposes, on websites and social media, and for any other purpose. 

Tag

The Tag feature of the Lux Member Site allows customers to tag content to create a custom favorites list. We may review information about your use of Tag, including the content you tag, and use such information to recommend content, tools, or other Lux services we think may be of interest to you. Unless we allow you to share Tagged content and notes with other customers, information about your use of Tag will only be accessible to Lux.

Member Website

If you access our members-only website, we may collect information about your access to and use of research materials, decision-support tools, and other online and offline resources we offer.

General Benchmarking and Research Purposes

Lux may use information collected through surveys or otherwise provided to or generated by Lux for validation, research and benchmarking purposes, and product development. 

2. WHEN WE DISCLOSE YOUR PERSONAL INFORMATION

We may disclose your personal information to third parties as follows:

  • When we have your consent or authorization to do so.
  • To third parties who work on our behalf to service or maintain business contact databases and other IT systems (such as suppliers of the IT systems we use to process or store personal information) or who provide other technical services (such as printing or payment processing).
  • To third parties providing services to us or on our behalf who have a need to access your information (such as our professional advisors, including auditors and lawyers, or venues for our events).
  • To comply with applicable laws; to protect rights, safety, and property; and to respond to lawful requests from public authorities (such as disclosing data in appropriate situations for national security or law enforcement purposes).
  • Subject to applicable law, in connection with a corporate change, such as a merger or sale of Lux or a transfer of some or all of our assets (including in bankruptcy), or for pre-transaction review in relation to such transactions.

Your personal information may be shared if we anonymize and/or aggregate it. Anonymized or aggregated information will cease to be personal information.

Utilization Information

We may share information with our organizational customers about how their employees use the sites and the resources available to them through the sites (such as how employees used certain features, utilization trends, and which features were most popular with the customer’s employees).

3. DATA SUBJECT RIGHTS

In certain circumstances, you have certain rights regarding the personal information we collect or maintain about you. A summary of each right and how you can exercise it is set out below.

If you live in certain U.S. states or in certain other countries or regions, you may have additional rights under applicable privacy and data protection laws.

  • We no longer require the personal information for the purposes of processing, but are required to keep it in connection with a legal claim
  • You have exercised your right to object to the processing. The restriction will apply until we have taken steps to verify whether we have compelling legitimate grounds to continue processing
Right to request deletion of your personal information

You have the right to ask us to delete your personal information in certain circumstances. There are exceptions where we may refuse a request for erasure, such as where the personal information is required to complete a transaction with you, to comply with a legal obligation, or for the establishment, exercise, or defense of legal claims.

If you want to opt out from receiving marketing communications, the best way to do so is to allow us to retain your information with a “do not contact” tag so we know not to contact you in the future, rather than asking us to delete your information.

Right to object to processing of your personal information

You may object to our use of your personal information for marketing purposes.

You may also object to processing of your personal information in cases where we have used legitimate interests as the basis for processing. In such cases, we will stop processing your personal information until we verify that we have compelling legitimate grounds for processing that outweigh your interests, rights, and freedoms in asking us to stop processing the data, or in limited cases where we need to continue processing the data for the establishment, exercise, or defense of legal claims.

Right to data portabilityIn most cases, you have the right to receive all personal information you have provided to us in a structured, commonly used, and machine-readable format and to transmit this data to another data controller, where technically feasible.
Right to lodge a complaint with a supervisory authority

If you object to our processing of your personal information, the data protection laws of some jurisdictions give you the right to complain to a data protection authority (“DPA”), depending on the state or country in which you reside, work, or where the alleged infringement of data protection laws has taken place.  Please contact us to be directed to the relevant DPA.

We agree that any disputes regarding our privacy policies and related actions regarding personal information from data subjects in the EU can be heard by a DPA and we will be subject to the determination of those bodies.

To opt out of receiving commercial communications, please click on the “unsubscribe” link in the communication or send an email to security@luxresearchinc.com. To exercise any of your other rights (such as the right to access or deletion of your information), please complete the form at https://luxresearchinc.com/lux-privacy-rights/. Such requests should include information to allow us to verify your identity (such as your name, address, email address, or other information reasonably required), a description of the right you want to exercise and the information to which your request relates.

Where we receive your request to exercise one of these rights, we will respond without undue delay and within the time required by applicable law. Depending on factors such as the type and complexity of the request, this time may be extended in certain circumstances. We will not discriminate against you in any way for submitting a request or exercising any of your other rights under applicable law.

We will provide the information free of charge, except where requests are manifestly unfounded, excessive, or repetitive. In these circumstances we may charge a reasonable fee to cover the administrative costs of complying with a request or decline to comply with a request. We will advise you of any fees prior to proceeding with a request. We may ask for additional information to verify your identity before carrying out a request. You may also authorize a third party to submit any of these requests on your behalf; however, we may ask for confirmation of your authorization.

4. INTERNATIONAL TRANSFERS

Lux is a global company and we may transfer personal information to other affiliated companies or suppliers outside your country. Lux will take reasonable steps to ensure that personal information is protected and any such transfers comply with applicable law.

Lux may transfer and maintain the personal information of individuals located in the European Economic Area (“EEA”) or the United Kingdom to servers or databases located outside the EEA or the United Kingdom.

The countries to which we transfer data outside of the EEA and the United Kingdom may include any of the countries in which Lux does business. A list of Lux office locations can be found at https://luxresearchinc.com/overview/.

5. HOW LONG WE RETAIN YOUR INFORMATION

We will retain your personal information for as long as we need it for the purposes described in this Policy, unless a longer retention period is required by law (such as tax, accounting, or other legal requirements), to resolve disputes, or to enforce applicable agreements. Personal information may persist in copies made for backup and business continuity purposes for additional time. Nothing in this notice requires us to keep your personal information for any minimum period of time.

If we have no continuing legitimate business need to keep your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further use until it can be deleted in the normal course of business.

6. CHOICES ABOUT YOUR INFORMATION

We believe it is important to give you choices about the use of your information. We will use your information as described in this Policy. If we want to use your information for a purpose not described in this Policy, we will first get your consent to do so.

Marketing Communications

We will respect your wishes not to receive marketing communications. You can change your marketing preferences by contacting us at security@luxresearchinc.com. If you gave us your email address to receive marketing communications, you can opt out at any time by using the unsubscribe links or instructions included at the bottom of our emails. Please note that we will continue to send you service-related communications regardless of any opt-out request. We will not sell or share your information with third parties (other than our subsidiaries or affiliates) for their own promotional or marketing purposes unless you give us consent to do so and where permitted by applicable law.

7. SECURITY

We have implemented administrative, technical, and physical security measures to help protect the security of any personal information we collect and prevent unauthorized access. Despite these measures and our efforts to secure your information, no data transmission over the Internet or information storage technology can be entirely secure and we cannot guarantee or warrant the security of any information you transmit via our websites. Transmission of personal information to and from our websites is at your own risk. You should only access our websites within a secure environment. Please note that you are responsible for maintaining the security of your credentials used to access any Lux service or account, and you must report suspected unauthorized activity to us. You are responsible for activity conducted with your credentials.

We make reasonable efforts to restrict access to information to only those employees, contractors, and agents who need such access in order to operate, develop, improve, or deliver our programs, products and services.

8. COOKIES AND SIMILAR TECHNOLOGIES

A cookie is a small text file that includes a unique identifier that is sent by a web server to the browser on your computer, mobile phone, or any other internet-enabled device when you visit an online site. Cookies and similar technologies are widely used to make websites work efficiently and to collect information about your online preferences.

Some of our website pages may contain electronic images known as web beacons (also known as clear gifs, tags, or pixels) that allow us to count users who have visited our pages. Web beacons collect only limited information (such as a cookie number, time and date of a page view, and a description of the page on which the web beacon resides). We may also carry web beacons placed by third party advertisers. These beacons do not carry any information that could directly identify you. We also include web beacons in e-mail messages or newsletters to track whether you open the messages. We use this information to customize our services and measure the overall effectiveness of our online content, advertising campaigns, and products and services we offer through the Site. Flash cookies operate differently than browser cookies, and cookie management tools available in a web browser will not remove flash cookies. To learn more about how to manage flash cookies, you can visit the Adobe website and make changes at the Global Privacy Settings Panel.

10.  MINORS

Our websites, products, and services deliver business-related content and are not directed to persons under the age of 18. We do not knowingly collect personal information from anyone under the age of 18. If you are a parent or guardian of a minor and become aware that your child has provided us with personal information, please contact us using the contact information provided at the end of this Policy and we will take reasonable steps to remove such information promptly.

11.  CALIFORNIA PRIVACY RIGHTS & NOTICE OF COLLECTION

California law requires us to provide California residents with additional information regarding how we collect, use, and share your personal information.

Categories of personal information we collect. In Section 1 above, and otherwise throughout this Policy, we discuss in detail the specific pieces of information we collect from and about individuals who use our websites, register for and attend our events, or use our products or services. We do share certain information as set forth in Sections 1 and 2 of this Policy, and allow third parties to collect certain information about your activity, for example through cookies, as explained in Section 8, above.  You have the right to opt out of sharing your personal information for targeted advertising and may do so by clicking the link below. Please note that if you opt out of this sharing, you may still continue to see advertising on other companies’ websites from Lux, but those ads may not be as relevant to you. Sharing for targeted advertising is limited to data collected from our public website and does not occur when individuals are logged in to the Member Site.
