Artificial Intelligence (AI) Policy

OUR APPROACH TO USING AI IN OUR RESEARCH

Generative AI has become a very powerful tool to process, structure, and create text and graphics. Lux Research actively seeks to use that power to enhance our research and better serve our clients. At the same time, the real added value of our research lies in the knowledge, thought leadership, and experience of our analysts and the data they collect and curate through primary research. Generative AI cannot substitute for that value — but it can help multiply that value and make it more accessible to our clients. These are our principles when using AI.

WE USE AI TO MAKE OUR RESEARCH MORE ACCESSIBLE AND PROVIDE ADDITIONAL FEATURES

Lux Research develops AI tools that generate content for our clients on our platform. One example is the predictive anthropology tool that uses AI to generate a direct response to questions clients enter on our site. We will be releasing more tools like it, but they always adhere to the following basic principle.

  • Clients will always know if a result has been entirely generated by AI. When it is not mentioned explicitly that a report or other piece of research was generated by AI, clients can be assured that it was written by one of our analysts and has gone through our rigorous quality assurance process of content and copy editing before publication.
  • When we provide a custom response to clients that has been generated by AI, the AI tool will base its response on research that was previously generated and edited by our team of analysts. We use AI tools and workflows that have been carefully designed, tested, and optimized with extensive expert input, using data sources and queries that have been curated by our experts, and monitored for quality on an ongoing basis by Lux experts. These tools are used to assemble and structure a response to questions posed by our clients using our research and, where applicable, drawing on data sets that have been selected and curated by Lux experts, such as the consumer conversations analyzed by our MotivAI tool.
  • We also use AI tools to provide additional research content on top of our ongoing analyst-written content. For instance, in our coverage of innovative companies on our Lux Lists, our analysts continue to write custom Innovator Assessments based on primary research for the companies we’ve identified as the top players in each technology. However, we now also provide information about companies that we have not interviewed; this information has been assembled automatically by Lux Research’s proprietary AI tool that was specifically developed by Lux for this purpose. In accordance with the principles above, these descriptions are clearly labeled as AI generated, and Lux Research analysts have designed and tested this tool and continue to supervise it, making improvements where needed.
  • Every Lux Take we provide about an innovation or innovator is the opinion of the Lux team and written by one of our analysts. When a Lux Take is provided, it is based on research performed by our analysts and written by our analysts, even if the information presented about the company has been generated by our AI tool.

WE USE AI TOOLS TO MAKE OUR ANALYSTS BETTER AT THEIR JOB

In the course of their research, our analysts read and process large amounts of text and information. Generative AI can help them do that faster and more accurately. We use AI tools in our research to improve quality, reliability, and productivity, just like our analysts use many other tools such as literature databases, patent search engines, etc. When using generative AI and other tools, the following principles apply.

  • All written research is the original work of our analysts. We do not allow any form of plagiarism and that includes copying text originally generated by AI tools without proper citation. All text and figures not originally conceived by our analysts will only be used with clear reference to the source.
  • If that source is an AI tool, the reference will mention which tool was used and on which date.
  • Our analysts will use AI tools to edit text originally conceived by our analysts to make it more concise, easier to read, and more consistent with our templated deliverable formats. When an AI tool is used only to edit text, this is not labeled as generated by AI. We use AI tools to edit, just like we use spelling- and grammar-checking tools. The final version is always edited by our analyst.
  • Every original piece of research is subject to our quality assurance process. This means it is reviewed in at least two iterations for content, recommendations, and language quality by experienced and trained subject-matter experts and professional editors. Our editors check references to source data and cited text.

Our team of scientists, anthropologists, business executives, and engineers is dedicated to understanding advanced technologies, consumer trends and physical sciences to inspire commercial innovation. Our mission is to help you place the right bets on innovation that will positively impact your organization and the world.

One of the most valuable components of your Lux membership is direct access to our experts through advisory sessions. These inquiries provide personalized insights to help you navigate complex technology landscapes, refine consumer understanding, revalidate strategic initiatives, and elevate innovation roadmaps.

What is a Lux Analyst Inquiry?

A Lux analyst inquiry is a 50-minute virtual conversation between a licensed advisory or executive partner member and a Lux expert. These sessions are designed to provide you with actionable insights tailored to your specific challenges and opportunities.

If an advisory or executive member has an Research membership attached to their subscription, Research members may also attend the inquiry, enabling seamless collaboration within your team.

How We Support You

  • Inquiries can be requested using the online scheduling tool on the Lux Membership site, or via your dedicated Client Experience Manager.
  • Inquiry submissions will receive an acknowledgment within 48 business hours to ensure timely engagement.
  • Lux will use best efforts to respond to inquiries within 14 business days, prioritizing your needs.
  • Some topics may require multiple inquiries for deeper exploration, and follow-ups can be scheduled as needed within your contract provisions.

Ensuring High-Quality Insights

To maintain the highest quality and integrity of our advisory services:

  • Lux does not conduct custom primary or secondary research as part of an inquiry.
  • Existing research materials may be shared at the expert’s discretion, but custom presentations will not be developed for inquiries.
  • If your inquiry falls outside Lux’s core expertise, we will make every effort to identify a suitable expert, though availability cannot be guaranteed.

Confidentiality and Compliance

Your privacy and intellectual property are our top priorities:

  • All inquiries remain strictly confidential between your organization and Lux Research.
  • Inquiry calls may be recorded for internal notetaking but will never be shared externally in written or audio form.
  • We do our best to provide summarized notes with the next steps after every inquiry session.

Maximizing Your Membership Value

Inquiries are a powerful tool to accelerate your innovation strategies. We encourage you to leverage these sessions to gain expert perspectives, challenge assumptions, and explore emerging trends. Our goal is to provide the right insights at the right time, helping you stay ahead in a rapidly evolving landscape.

RightExplanation
Right to access your personal informationYou have the right to access personal information we hold about you and to be provided with a copy of the information (in most circumstances).
Right to correct your personal information You have the right to ask us to update or correct any information we may hold about you that is inaccurate.
Right to restrict use of your personal information

You have the right to ask us to restrict processing of your personal information where one of the following applies:

  • Where you contest the accuracy of your personal information. The restriction will apply until we have verified the accuracy or corrected your personal information
  • We no longer require the personal information for the purposes of processing, but are required to keep it in connection with a legal claim
  • You have exercised your right to object to the processing. The restriction will apply until we have taken steps to verify whether we have compelling legitimate grounds to continue processing
Right to request deletion of your personal information

You have the right to ask us to delete your personal information in certain circumstances. There are exceptions where we may refuse a request for erasure, such as where the personal information is required to complete a transaction with you, to comply with a legal obligation, or for the establishment, exercise, or defense of legal claims.

If you want to opt out from receiving marketing communications, the best way to do so is to allow us to retain your information with a “do not contact” tag so we know not to contact you in the future, rather than asking us to delete your information.

Right to object to processing of your personal information

You may object to our use of your personal information for marketing purposes.

You may also object to processing of your personal information in cases where we have used legitimate interests as the basis for processing. In such cases, we will stop processing your personal information until we verify that we have compelling legitimate grounds for processing that outweigh your interests, rights, and freedoms in asking us to stop processing the data, or in limited cases where we need to continue processing the data for the establishment, exercise, or defense of legal claims.

Right to lodge a complaint with a supervisory authority

If you object to our processing of your personal information, the data protection laws of some jurisdictions give you the right to complain to a data protection authority (“DPA”), depending on the state or country in which you reside, work, or where the alleged infringement of data protection laws has taken place.  Please contact us to be directed to the relevant DPA.

We agree that any disputes regarding our privacy policies and related actions regarding personal information from data subjects in the EU can be heard by a DPA and we will be subject to the determination of those bodies.

To opt out of receiving commercial communications, please click on the “unsubscribe” link in the communication or send an email to security@luxresearchinc.com. To exercise any of your other rights (such as the right to access or deletion of your information), please complete the form at https://luxresearchinc.com/lux-privacy-rights/. Such requests should include information to allow us to verify your identity (such as your name, address, email address, or other information reasonably required), a description of the right you want to exercise and the information to which your request relates.

Where we receive your request to exercise one of these rights, we will respond without undue delay and within the time required by applicable law. Depending on factors such as the type and complexity of the request, this time may be extended in certain circumstances. We will not discriminate against you in any way for submitting a request or exercising any of your other rights under applicable law.

We will provide the information free of charge, except where requests are manifestly unfounded, excessive, or repetitive. In these circumstances we may charge a reasonable fee to cover the administrative costs of complying with a request or decline to comply with a request. We will advise you of any fees prior to proceeding with a request. We may ask for additional information to verify your identity before carrying out a request. You may also authorize a third party to submit any of these requests on your behalf; however, we may ask for confirmation of your authorization.

Personal information may persist in copies made for backup and business continuity purposes for additional time. Nothing in this notice requires us to keep your personal information for any minimum period of time.

If we have no continuing legitimate business need to keep your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further use until it can be deleted in the normal course of business.

Lux AI

EULA

This End User License Agreement (“Agreement”) is a legal agreement between Lux Research, Inc., on behalf of itself and its wholly owned subsidiaries (collectively, “Lux,” “we,” “us,” or “our”), and the organization that has contracted with Lux for access to Lux AI (“Customer”), together with each individual whom Customer authorizes to use Lux AI (“User,” “you,” or “your”). It governs your installation, enablement, access to, and use of Lux AI (the “App”).

Lux AI is a Lux application that makes Lux research data available within Customer’s generative AI environment (such as Microsoft 365 Copilot) so that Authorized Users can query, search, summarize, and fact-check against Lux research.

By installing, enabling, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not install, enable, access, or use the App. The App is licensed, not sold.

1. Relationship to the Services Agreement

The App is provided as part of, and is subject to, the master services or subscription agreement, or other terms agreed upon between Lux and Customer (the “Services Agreement”). This Agreement supplements the Services Agreement and sets out additional terms that are specific to the App. If there is a conflict between this Agreement and the Services Agreement with respect to the App, this Agreement controls as to matters specific to the App; in all other respects, the Services Agreement controls. Capitalized terms used but not defined in this Agreement have the meanings given in the Services Agreement.

2. Definitions

(a) “App” or “Lux AI” means the Lux application that connects Lux Research Data into the Customer Environment and enables Authorized Users to query, search, summarize, and fact-check against that data, including any updates Lux makes available.

(b) “Authorized User” means an employee, officer, or director of Customer or its Affiliate whom Customer has authorized to access the App and who holds a valid entitlement under the Services Agreement.

(c) “Customer Environment” means the AI Platform together with Customer’s related accounts, tenants, and services into or through which the App operates.

(d) “Lux Research Data” means the research content, data, reports, analyses, and other Lux Content made available to Customer through the App, together with any portions, copies, or derivatives of the foregoing.

(e) “Output” means any response, summary, answer, citation, or other content generated through the Customer Environment in response to a Prompt that is based on or derived from the Lux Research Data.

(f) “Prompt” means any query, instruction, or other input submitted to the App or to the AI Platform in connection with the App.

(g) “AI Platform” means the third-party generative AI platform, application, or service — such as Microsoft 365 Copilot — used by Customer in connection with the App.

3. License Grant

Subject to Customer’s and each Authorized User’s compliance with this Agreement and the Services Agreement — including payment of all applicable fees and maintenance of a current subscription — Lux grants Customer a limited, non-exclusive, non-transferable, non-sublicensable, revocable license during the term to (a) install and enable the App within the Customer Environment, and (b) permit Authorized Users to access and use the App and the Lux Research Data, in each case solely for Customer’s internal business purposes and solely within the scope of each Authorized User’s role with Customer. The number of Authorized Users and the scope of access are limited to the entitlements purchased under the Services Agreement. All rights not expressly granted are reserved to Lux.

4. Authorization to Use Within Generative AI Tools

The Services Agreement restricts the use of Lux Content with generative AI tools, including its use as input to tools such as Microsoft 365 Copilot. Notwithstanding those restrictions, Lux authorizes Customer and Authorized Users to use the Lux Research Data within the App and the Customer Environment solely as expressly permitted by, and strictly subject to, this Agreement. This authorization is limited to use of the App as intended and does not permit any other use of Lux Research Data with any AI system, model, or tool.

5. Restrictions

Customer shall not, and shall not permit any Authorized User or any third party to:

  • copy, download, export, scrape, harvest, or otherwise extract the Lux Research Data from the App or the Customer Environment, in whole or in part, except for the transient internal display of Output as permitted under this Agreement;
  • use the Lux Research Data, the App, or any Output to train, fine-tune, validate, develop, benchmark, or improve any machine-learning model, large language model, neural network, or other artificial intelligence system or tool;
  • modify, adapt, translate, or create derivative works of the Lux Research Data or the App;
  • rent, lease, lend, sell, sublicense, assign, publish, distribute, or otherwise make the Lux Research Data, the App, or any Output available to any third party;
  • provide access to the App or the Lux Research Data to any person who is not an Authorized User — including other employees, contractors, suppliers, or vendors — for any reason, including with the intent to avoid the purchase of additional entitlements;
  • exceed the number of Authorized Users or the scope of access purchased under the Services Agreement, or configure the Customer Environment so as to make the App or Lux Research Data available to users beyond that scope;
  • reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying structure of the App, except to the extent this restriction is prohibited by applicable law;
  • bypass, disable, interfere with, or circumvent any access control, security feature, or usage-tracking mechanism of the App; or
  • remove, obscure, or alter any proprietary notice, mark, attribution, or copyright notice on or relating to the Lux Research Data, the App, or any Output.

6. Ownership; Intellectual Property

As between the parties, Lux owns and retains all right, title, and interest in and to the App, the Lux Research Data, and all related intellectual property rights. This Agreement does not transfer any ownership rights to Customer. The Lux Research Data is and remains Lux’s proprietary and Confidential Information regardless of where it resides, including while it is ingested into, stored in, or accessed through the Customer Environment. The fact that Lux Research Data resides within the Customer Environment does not alter Lux’s ownership of, or Customer’s obligations with respect to, that data.

7. Output

(a) Subject to Customer’s compliance with this Agreement, Lux grants Customer a non-exclusive license to use Output for Customer’s internal business purposes only.

(b) To the extent any Output contains, reflects, quotes, or is derived from the Lux Research Data, that Output remains subject to the confidentiality obligations and use restrictions of this Agreement and the Services Agreement.

(c) Customer is solely responsible for its use of, and for any decision made in reliance on, any Output.

(d) Customer shall not represent any Output as Lux’s advice, opinion, or work product, or publicly attribute Output to Lux, except for the limited internal disclosures expressly permitted under the Services Agreement.

8. Customer Responsibilities; the Customer Environment

The App operates within the Customer Environment, which Customer controls. Customer is solely responsible for:

  • configuring, securing, administering, and maintaining its accounts, tenants, and instances for the AI Platform;
  • determining which Authorized Users may access the App, provisioning and de-provisioning their access, and ensuring such access does not exceed purchased entitlements;
  • all activity that occurs through its Authorized Users’ accounts and credentials; and
  • its Prompts and any Customer data it submits to or makes available within the App or the Customer Environment.

Customer is responsible for ensuring that its Prompts and use of the App comply with applicable law and do not infringe the rights of any third party. Customer acknowledges that, depending on its AI Platform configuration, the App may interact with Customer’s own data, and that Lux neither controls nor is responsible for such configuration. Lux is not responsible for the security, availability, or operation of the Customer Environment or the AI Platform.

9. Confidentiality

The App and the Lux Research Data constitute Lux’s Confidential Information. Customer shall protect them in accordance with the confidentiality provisions of the Services Agreement and shall not use or disclose them except as expressly permitted by this Agreement and the Services Agreement. These confidentiality obligations apply notwithstanding that the Lux Research Data resides within the Customer Environment.

10. Data Protection and Privacy

Lux’s collection and use of personal information in connection with the App is described in the Lux AI Privacy Policy. Customer acknowledges that Prompts, Output, and related interactions occurring within the Customer Environment are processed by the applicable AI Platform provider within Customer’s environment and are governed by Customer’s own agreements with that provider, and that Lux does not routinely access the content of those interactions. Each party shall comply with the data-protection laws applicable to it.

11. AI Platform; Third-Party Platforms

The App requires a compatible third-party generative AI platform (such as Microsoft 365 Copilot) and sufficient capacity on that platform, which Customer must obtain and maintain at its own expense. The AI Platform is provided by the applicable third-party provider, not by Lux, and is subject to Customer’s separate agreements with that provider. Lux makes no representations or warranties regarding the AI Platform and shall have no liability arising from it.

12. Warranties; Disclaimer

(a) Lux warrants that it will provide the App with the level of skill and care ordinarily exercised in the research industry.

(b) EXCEPT AS EXPRESSLY STATED IN SECTION 12(a), THE APP, THE LUX RESEARCH DATA, AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, AND LUX DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LUX DOES NOT WARRANT THAT THE APP OR ANY OUTPUT WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, OR ERROR-FREE.

Output is generated with the assistance of AI systems, which can produce inaccurate, incomplete, or fabricated information. Output does not constitute, and is not a substitute for, legal, financial, investment, tax, or other professional advice, and does not reflect the considered opinion of any Lux analyst. Customer is responsible for independently verifying any Output before relying on it, including when using the App to fact-check, validate, or support its own reports or decisions.

13. Limitation of Liability

The limitation of liability set out in the Services Agreement governs the parties’ liability under this Agreement and is incorporated by reference; it is not duplicated, increased, or waived by this Agreement.

14. Term; Termination

(a) This Agreement is effective when Customer first installs, enables, or uses the App and continues for the term of the applicable subscription under the Services Agreement.

(b) This Agreement and all licenses granted under it terminate automatically upon expiration or termination of the applicable subscription or the Services Agreement, or upon Customer’s material breach of this Agreement. Lux may also suspend or terminate access to the App as provided in the Services Agreement.

(c) Upon any expiration or termination: (i) all licenses granted under this Agreement immediately end; (ii) Customer and all Authorized Users shall cease all use of the App and the Lux Research Data; and (iii) Customer shall, within thirty (30) days, remove, delete, or disable the App and the Lux Research Data from the Customer Environment, and shall certify such removal in writing upon Lux’s request.

(d) Sections 5 through 13 and Sections 15 and 16 survive expiration or termination.

15. Governing Law; Venue

Governing law and venue for this Agreement are as set out in the Services Agreement.

16. General

(a) Entire Agreement. This Agreement, together with the Services Agreement and the Lux AI Privacy Policy, constitutes the entire agreement between the parties regarding the App and supersedes all prior understandings regarding its subject matter.

(b) Changes. Lux may update this Agreement from time to time. Lux will make the updated Agreement available, and material changes will be communicated to Customer. Continued use of the App after an update takes effect constitutes acceptance of the updated Agreement.

Privacy Policy

This Privacy Policy describes how Lux Research, Inc., on behalf of itself and its wholly owned subsidiaries (collectively, “Lux,” “we,” “us,” or “our”), collects, uses, and discloses personal information in connection with Lux AI (the “App”) — our application that makes Lux research data available within your organization’s third-party generative AI platform, application, or service — such as Microsoft 365 Copilot (the “AI Platform”).

Scope of This Policy

This Policy applies to the personal information Lux processes in order to provide and support the App. It does not cover:

  • your organization’s own AI Platform environment, including the content of your prompts and the responses generated within it, which are processed within your organization’s tenant or account with the AI Platform provider and governed by your organization’s agreements with that provider; or
  • Lux’s other products and services (such as the Lux Member Site and analyst services), which are governed by separate agreements and privacy notices.

Our Role

The App is provided to enterprise customers under a contract between Lux and the customer organization. Lux acts as a controller with respect to the limited account, provisioning, support, and usage information described below. Where Lux processes personal information on behalf of a customer under the applicable agreement, Lux does so as a processor (or service provider), acting on that customer’s documented instructions. With respect to most personal information processed within a customer’s AI Platform environment — such as the content of Prompts and Output — the customer organization and the AI Platform provider control that processing, and Lux does not routinely access it.

Information We Collect

Account and provisioning information

Business contact details of customer administrators and Authorized Users (such as name, business email address, job title, and organization), together with subscription and entitlement details. We use this information to activate, provision, and manage access to the App.

Usage and diagnostic information

Limited technical and operational data about how the App functions, such as activation status, feature usage, configuration metadata, and error and performance logs. We use this information to operate, secure, troubleshoot, and improve the App. This information is not used to reconstruct the substance of your prompts or research queries.

Support information

Information you provide when you contact us for support, such as your description of an issue, steps to reproduce it, screenshots you choose to share, and related correspondence.

Device and connection information

Where applicable to the delivery of the App, technical information such as device or application identifiers and IP address, collected to operate and secure the service.

Information We Generally Do Not Access

The content of Prompts, queries, and Output generated within your organization’s AI Platform environment remains within your organization’s tenant or account with the AI Platform provider and is governed by your organization’s agreements with that provider. Lux does not routinely access that content, and Lux does not use it to train, develop, or improve any AI model.

How We Use Information

We use the information described above to:

  • provide, maintain, secure, and improve the App;
  • activate and manage subscriptions, entitlements, and Authorized User access;
  • respond to your requests and provide support;
  • monitor and analyze the operation, performance, and security of the App;
  • comply with legal obligations and enforce our agreements; and
  • protect the rights, property, and safety of Lux, our customers, and others.

How We Share Information

We do not sell personal information, and we do not use customer content to train AI models. We may share information with:

  • service providers and subprocessors that help us host, operate, secure, and support the App, under obligations of confidentiality and data protection;
  • the AI Platform provider, as the platform on which the App runs, to the extent necessary to provision and operate the App;
  • our affiliates, for the purposes described in this Policy;
  • authorities or other parties when required by law, legal process, or to protect our rights; and
  • a successor in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

International Transfers

We may process and store information in the United States and in other countries where we or our service providers operate. Where required, we implement appropriate safeguards for cross-border transfers of personal information.

Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Policy, to provide the App for the duration of the applicable subscription, and to comply with our legal, accounting, and contractual obligations. Lux Research Data within your environment is removed, deleted, or disabled following expiration or termination as described in the End User License Agreement.

Data Security

We implement reasonable technical and organizational measures designed to protect personal information against unauthorized access, use, alteration, and disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your Rights and Choices

Depending on your location, you may have rights to access, correct, delete, restrict, or object to the processing of your personal information, or to data portability. To exercise these rights, contact us at info@luxresearchinc.com.

Children’s Privacy

The App is a business tool intended for use by enterprise organizations and is not directed to children. We do not knowingly collect personal information from children.

Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated “Last Updated” date, and material changes will be communicated to affected customers.

Support

We’re here to help you get the most out of Lux AI — the Lux application that brings Lux research data into your generative AI platform (such as Microsoft 365 Copilot) so your team can query and fact-check against Lux research.

How to Get Support

You can reach us through any of the following:

  • Email: info@luxresearchinc.com
  • Your Lux Customer Experience Manager (CXM), for account-level and onboarding questions

What We Support

Lux support covers the installation, configuration, and operation of Lux AI, and questions about the Lux research data made available through it. Support for the underlying AI platform itself is provided by your AI platform provider under your organization’s agreements with that provider.

Specific service levels, if any, are set out in your agreement with Lux.

System Requirements

To use Lux AI, your organization needs:

  • an active Lux AI subscription with Lux; and
  • a compatible generative AI platform license with sufficient capacity or usage entitlements for that platform.

Getting Started

Because Lux AI is provided under a contract between your organization and Lux, access begins once your subscription is in place. Your Lux CXM coordinates activation, and your administrator enables Lux AI within your environment and assigns access to Authorized Users. Lux AI is not acquired from a public marketplace; it is provisioned to your organization directly under your agreement with Lux.

Frequently Asked Questions
